Thank you for purchasing our products on the website www.facelyapp.ai ("Product") by Genius99 LTD ("Company"). The Company offers you a refund right for purchases that are directly made on the website www.facelyapp.ai ("Website"), if you are not satisfied with the Product, provided that the conditions set forth in this Refund Policy are met, in addition to the refund rights that are mandatorily granted by the applicable laws.

I. SUBSCRIPTION

The Website is provided by Genius99 LTD on a free basis. Once you start using the Website, you will have access to basic features of the Facely platform. Access to unlimited features requires paid subscriptions. The full list of Facely’s features and pricing is provided on the Website. You can choose different subscription options. Prices are in U.S. dollars and may vary in countries other than the U.S. You will have all the necessary information about your subscription plan before the purchase. Your subscription will be automatically renewed within 24 hours before the current subscription ends. Please see Section IV. CANCELLATION to understand how to cancel your subscription.

II. FREE TIER

You may have an opportunity to try free tier options by generating your first image. To continue using the full features of the platform, you should choose one of the paid subscriptions provided on the Website.

III. PAYMENT METHODS

You can pay for your subscription via debit or credit card. The payment is processed via Stripe or other authorized payment providers. Payment will be charged to the payment method you provided at the time of purchase. You authorize us to charge the applicable subscription fees to the payment method that you have chosen.

IV. CANCELLATION

Canceling your subscription means that automatic renewal will be disabled, but you will still have access to all your subscription features for the remainder of your current period.

Note that deleting the app does not cancel your subscriptions.

• If purchased via App Store: You must request a refund directly from Apple via their support page.

• If purchased via Google Play: You must request a refund directly from Google via their support page.

• If purchased via our Website: You can cancel your subscription via the Stripe Customer Portal. The link is shared via email upon purchase confirmation. You may also contact us at support@facelyapp.ai.

To avoid being charged for your next billing period, cancel your subscription at least 24 hours before your next billing date. Subscription fees are non-refundable.

V. REFUNDS

All purchases are generally considered final and non-refundable. However, under certain conditions, refunds may be issued:

Refund Requests Within 7 Days:

• To be eligible for a refund, you must submit your request within 7 days of purchasing directly from our Website.

• Refund eligibility depends on product usage.

• If you have generated 3 or fewer images, you may qualify for a refund.

• If you have generated more than 3 images, your usage is considered active and your purchase is non-refundable.

Exceptions:

• Beyond 7 Days: Refunds will not be issued after this period.

• Active Usage: Refunds will not be issued if your usage exceeds 3 generated images.

General Conditions:

• Payments are non-refundable and/or non-exchangeable if the conditions of this Refund Policy are not met.

• If a free trial or alternative refund option is presented at checkout, that option supersedes this policy.

VI. CHARGEBACKS / DISPUTES

If you initiate a chargeback or reverse payment for any subscription fee, we may disable or terminate your account immediately. We reserve the right to dispute any chargeback by providing proof of authorized transactions.

VII. CHANGES TO THIS REFUND POLICY

We reserve the right to update this Refund Policy at any time. We will notify you of significant changes via the App, email, or other appropriate methods. If you do not agree to the revised terms, you may cancel your subscription before the changes take effect.
